ONLINE STORE TERMS & CONDITIONS

PATRICIA WRITES CALLIGRAPHY

I. GENERAL PROVISIONS

These Terms and Conditions of the Online Store (hereinafter referred to as the “Terms”) set out the rules under which the Seller and Customers enter into distance sales contracts for Goods using electronic means of communication, in particular e-mail, via the Seller’s website operating at Osiedle Kosmonautów 15/20, 61-639 Poznań, as well as the rules for the provision of electronic services by the Seller via the above-mentioned Website.

The Terms constitute an integral part of the agreement for the provision of electronic services and the sales contract concluded with the Customer.

All exclusive rights to the content made available as part of the services provided via the Online Store, including copyright, the Store name, graphic elements, software, and database rights, are legally protected and belong to the Seller or entities with whom the Seller has concluded relevant agreements.

Customers and Service Users may access these Terms free of charge at any time via the “Terms & Conditions” tab on the Store’s Website and may print them.

All Goods offered in the Online Store are new and protected by copyright.

Due to the artisanal and handmade nature of certain Goods, slight differences between individual items may occur. Any such differences result solely from the production process and do not constitute defects.

The Seller informs Customers that, due to their handmade character, the Goods should be used only as intended and stored and maintained in accordance with their properties.

A Consumer within the meaning of the Consumer Rights Act may not waive the rights granted under that Act. Any contractual provisions less favorable to the Consumer than statutory provisions are null and void, and the statutory provisions apply instead. These Terms do not aim to exclude or limit any consumer rights arising from mandatory legal provisions, and any doubts shall be interpreted in favor of the Consumer.

II. DEFINITIONS

For the purposes of these Terms, the following definitions apply:

Administrator / Seller / Service Provider – Patricia Renee Balboa, conducting business under the name “Patricia Writes Calligraphy” Patricia Renee Balboa, NIP 9721373606, REGON 543534050.

Order Processing Time – the time required by the Seller to prepare and dispatch an Order.

Business Days – Monday to Friday from 10:00 a.m. to 6:00 p.m., excluding public holidays.

Delivery – the act of delivering the Goods specified in the Order to the Customer via a Delivery Provider.

Delivery Provider – a courier or postal company cooperating with the Seller.

Password – a confidential string of at least 12 characters (letters, numbers, and special characters) set by the Customer during Registration.

Customer – a natural person with full legal capacity, a legal person, or an organizational unit with legal capacity making purchases in the Online Store.

Consumer – a natural person acting for purposes not directly related to their business or professional activity.

Cart – the Online Store feature allowing Customers to select Goods for purchase.

Entrepreneur – a person or entity conducting business or professional activity.

Entrepreneur with Consumer Rights – a natural person concluding a sales contract directly related to their business activity, provided the contract does not have a professional character for that person.

Terms – these Terms and Conditions for distance sales and electronic services.

Registration – the process of creating a Customer account using an e-mail address and Password.

Studio Address – Osiedle Kosmonautów 15/20, 61-639 Poznań.

Online Store / Store – the Seller’s online sales platform.

Website – the website operating at Osiedle Kosmonautów 15/20, 61-639 Poznań.

Goods – products offered for sale on the Website.

Sales Contract – a distance sales contract concluded between the Customer and the Seller.

Electronic Service – a service provided electronically by the Service Provider (account, order form, newsletter, contact form).

Service User – an entity using or intending to use Electronic Services.

Order – a declaration of intent submitted via the order form to conclude a Sales Contract.

III. TECHNICAL REQUIREMENTS

To use the Store, Customers must have:

* a computer or mobile device with Internet access,

* a graphical operating system (Windows, macOS, Linux, Android),

* a modern web browser supporting SSL, JavaScript, and cookies,

* an active e-mail account.

Failure to meet these requirements may prevent placing Orders or using Electronic Services.

The Seller uses cookies to ensure proper operation of the Website. Cookies do not damage devices or alter software settings. Disabling cookies may affect Website functionality.

The Seller makes reasonable efforts to ensure uninterrupted operation of the Store but reserves the right to temporary interruptions due to maintenance or updates.

IV. CUSTOMER OBLIGATIONS

Customers undertake to:

* respect copyright and intellectual property rights,

* use the Store in a lawful and non-disruptive manner,

* refrain from submitting unlawful content,

* avoid actions that interfere with the Store’s operation.

V. LIMITATION OF LIABILITY

The Service Provider is not liable for damages caused by Customers’ violations of the Terms or by force majeure, third-party actions, or technical issues beyond its control, to the extent permitted by law.

VI. CONCLUSION OF THE SALES CONTRACT

Information on the Website constitutes an invitation to conclude a contract, not an offer.

A Sales Contract is concluded once the Seller confirms acceptance of the Order by e-mail.

All prices are stated in Polish zloty (PLN) and include applicable taxes.

Orders may also be placed by phone and are confirmed on a durable medium.

VII. RECEIPTS AND INVOICES

Electronic receipts are issued for each Order. VAT invoices are issued upon request and sent in PDF format to the provided e-mail address.

VIII. PRICES

Prices are binding at the time of Order acceptance. The Seller reserves the right to change prices and promotions, without affecting Orders already placed.

IX. DELIVERY AND COSTS

Delivery is carried out via DPD, DHL, or InPost. Delivery costs are indicated during checkout.

Personal collection is free of charge.

X. ORDER PROCESSING TIME

Orders are dispatched within 3–14 business days after payment confirmation. Delivery will occur no later than 30 days from the Order date.

XI. PAYMENT METHODS

Accepted payment methods include:

* electronic payments,

* cash on delivery,

* bank transfer,

* credit card.

XII. COMPLAINTS

The Seller is liable for defects under statutory warranty rules.

Complaints are processed within 14 days.

XIII. RIGHT OF WITHDRAWAL

Consumers and Entrepreneurs with Consumer Rights may withdraw from the Sales Contract within 14 days without giving a reason.

Personalized Goods are non-refundable.

Returned Goods must be sent to:

Osiedle Kosmonautów 15/20, 61-639 Poznań.

XIV. PERSONAL DATA

Personal data is processed in accordance with the Privacy Policy available on the Website.

XV. ADDITIONAL SERVICES

The Seller provides:

* newsletter service,

* contact form.

Both services are free of charge.

XVI. FINAL PROVISIONS

Polish law applies to matters not regulated herein.

The Seller reserves the right to amend these Terms in accordance with applicable law.

The Terms enter into force on 6 February 2026.
